Liability For Orondo Box Truck Accidents

Accidents that involve debris that fell off of a truck may seem like freak occurrences, but they are actually quite common. According to one report from USA Today, more than 50,000 car accidents every year are caused by debris that fell into the roadway. These types of accidents cause around 125 fatalities and nearly 10,000 injuries annually. Most debris tends to fall onto interstate highways. There are a number of methods that drivers should take in order to prevent accidents involving falling debris.

  • Truck drivers should ensure that the back door of their trailer is properly latched.
  • Objects attached to the car must be properly secured.
  • Objects that are likely to roll should be properly secured with chocks, wedges or a cradle.

It is illegal for any driver to fail to properly secure their load. Pursuant to Maria’s Law, “A person who causes an injury or death by failing to secure a load properly can be charged with a gross misdemeanor and can face a maximum penalty of one year in jail and a $5,000 fine. […] Victims of such crimes are eligible for money from the state’s Crime Victims Compensation program.” Drivers that fail to properly secure their loads could also face civil liability for their actions.

If a truck driver was working at the time of  a collision, their employer could be liable for any accident caused by an improperly secured load. In general, companies are liable for the wrongful actions of their employees -insofar as those employees were working within the course and scope of their job duties. The company that loaded a truck could also be liable for such an accident. In many situations, truck drivers do not load their own trucks. There are a number of steps that should be taken after any truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

The family of any person that is killed in an accident involving debris in the roadway may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, companies will often fight hard to deny responsibility when they fail to secure loads and cause accidents. This is why it is so important that evidence is properly preserved after a crash.
