Liability In Sunnyvale Bicycle Accidents

Thousands of bicyclists are killed or seriously injured every year. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” Many bicycle accidents are totally preventable. There are a number of factors that could contribute to a bicycle accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Vehicle malfunctions
  • Driver intoxication

All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists. This includes driving at a safe speed and maintaining at least three feet of separation from bicyclists at all times. When a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. There are many steps that should be taken after a Sunnyvale bicycle accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An investigation should be conducted.

When a driver is negligent and strikes a bicyclist, they can be held at fault through a civil claim. The family member of any person that is killed in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. Sadly, though, drivers will often fight hard to deny liability for any accident.
