Liability In San Jose Hit-And-Run Pedestrian Accidents
Far too many people are killed or seriously injured every year in hit-and-run collisions. According to Value Penguin, “California experienced the largest share of fatal hit-and-runs in this period. The number of Golden State crashes accounted for 17% of the U.S. total, with 2,948 crashes causing 3,056 deaths.” There are a number of reasons that people flee the scene of car accidents.
- The at fault driver may have been intoxicated.
- The at fault driver may fear going to jail.
- The at fault driver may not realize that they hit someone.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. A large number of pedestrian collisions are due to drivers that are speeding. If a driver hits a pedestrian and then flees the scene, they could be held at fault through a civil or criminal claim. Victims of pedestrian accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Organ damage
The family of any victim that died in a San Jose hit-and-run collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often fight to deny liability for any crash. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
