Liability In Prather Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. Motorcyclists are particularly vulnerable in collisions. According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles.” There are many factors that could potentially contribute to a motorcycle accident.

  • Drivers that follow vehicles too closely.
  • Drivers that are traveling too fast for the prevailing conditions.
  • Drivers that are under the influence of alcohol or drugs.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to California Vehicle Code 21703, the driver of a motor vehicle shall not follow another vehicle more closely than would be reasonable and prudent given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle in their own lane. There are a number of steps that should be taken after any car accident.

  • Surveillance footage of the accident should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

Liability for a car accident could extend beyond an at fault driver if they were working at the time of a collision. The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can investigate all of the unique facts of your case and let you know what your legal options are.
