Penelope Fetsch Injured In Berkeley Car Accident on Colusa Avenue By Solano Avenue

BERKELEY, CALIFORNIA (August 20, 2022) – A woman identified as Penelope Fetsch was injured in a North Berkeley car accident near the intersection of Colusa Avenue and Solano Avenue.

Alameda County officials are saying that the accident took place around 7:15 p.m. on August 13. Penelope Fetsch was in a crosswalk when she was hit by a car making a right turn on Colusa Avenue.

Mark Olivier is the victim’s partner and said she was picking up food from a taqueria when she was hit by the car. Paramedics were called to the scene of the collision to help the victim.

Penelope Fetsch was taken to Highland Hospital and spent many hours in the emergency room and then intensive care. She was treated for broken ribs, pelvis injuries and several cuts and bruises.

Police interviewed the driver involved in the accident who remained at the scene. A full investigation remains ongoing at this time.

Liability In Berkeley Pedestrian Accidents

The Bay Area has consistently had some of the highest instances of pedestrian collisions across California. According to Berkeley Side, “Berkeley had significantly more fatal crashes and collisions causing injuries in 2021 than in the prior year, according to new traffic data released by police in February.” Most pedestrian collisions occur on a relatively small number of intersections. There are a number of factors that could potentially contribute to a pedestrian collision.

  • Speeding
  • Driver distraction
  • Inclement weather
  • Driver fatigue
  • Dangerous turns

All drivers have a legal obligation to scan the road ahead of them and take steps to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950 (a), the driver of any vehicle shall yield the right of way to any pedestrian crossing the roadway within a marked crosswalk at an intersection. If a driver fails to exercise due care in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the expenses that can come with a serious car accident. Sadly, though, drivers will often do everything in their power to avoid helping accident victims. A pedestrian accident attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
