Liability For San Francisco Bus Accidents
Buses are among the safest forms of transportation for bus passengers. But they pose a number of unique safety hazards for pedestrians and those in passenger vehicles. According to the FMCSA, “In 2020, 4,998 large trucks and buses were involved in fatal crashes, a 5-percent decrease from 2019. From 2019 to 2020, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles increased from 0.162 to 0.177, 14 percent below the 21st-century peak of 0.205 in 2000.” There are a number of steps that bus drivers should take in order to avoid hitting pedestrians.
- Bus drivers should check their blind spots before turns.
- Bus drivers should slow down in areas with heavy pedestrian traffic.
- Bus drivers should abstain from alcohol and other intoxicating substances.
Bus companies are considered “common carriers” and are held to a high standard in terms of safety. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way to any driver that is crossing within a lawfully marked crosswalk. A driver must reduce their speed and take any necessary action to safeguard the safety of any pedestrian in the roadway. If a bus driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.
Depending on the facts of any case, the company or municipality that a bus driver worked for could be held at fault for a collision. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any San Francisco bus accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- The bus driver’s logbook should be reviewed.
- An independent investigation should be conducted.
The family of any person that is killed in a San Francisco bus accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, bus companies will often fight hard to deny liability for any collision involving their driver. This is why it is so important that all evidence is properly preserved after any bus accident.
