Liability For San Francisco Car Accidents

California has one of the highest instances of pedestrian accidents in the United States. According to KTLA, “California saw the most pedestrian deaths, with 958 deaths recorded. The figure marks a 6 percent decrease from 2020, when the state reported 1,026 pedestrian deaths, however, giving it the largest decrease in the number of deaths on foot in a year’s time.” There are a number of steps that drivers should take to avoid pedestrian accidents.

  • Drivers should slow down in areas with heavy pedestrian traffic.
  • Drivers should continuously scan the road ahead of them.
  • Drivers should obey all traffic laws.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Many pedestrian accidents are due to drivers that are speeding. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. There are a number of steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An independent investigation should be conducted.

The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Unfortunately, it is common for drivers to deny liability for any crash. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
