Liability For San Francisco Pedestrian Accidents
Despite numerous measures and city officials implementing “Vision Zero,” San Francisco can still be a very dangerous place for pedestrians. Elderly people tend to be at the greatest risk. According to the San Francisco Department of Public Health, “From 1995 through 2004, 41% of pedestrian fatalities were seniors (age 65 or older). This is significant because seniors make up 14% of the population in San Francisco. Pedestrians over age 65 were 9 times more likely than younger people to have a fatal injury when hit.” There are many causes of pedestrian collisions.
- Drivers may not be paying adequate attention to the road ahead of them.
- Drivers may be under the influence of drugs or alcohol.
- Drivers may fail to see pedestrians due to trees or some structure blocking their vision.
All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. According to California Vehicle Code 21950, drivers must reduce their speed and take any other action necessary to safeguard the well-being of any pedestrian in the roadway. If a driver leaves the scene of an injury collision, they could face both civil and criminal liability for their actions. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Even after a person’s physical injuries have healed, many survivors of bicycle accidents often suffer from long term PTSD. Any person that is injured in a San Francisco collision on El Camino Real may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering.
