Liability For Rohnert Park Car Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. According to Bank Rate, “NHTSA’s early estimates show that there were around 42,915 traffic fatalities in 2021, up 10.5% from 38,823 fatalities in 2020.” The vast majority of these accidents are preventable and involve some amount of human error. There are a number of factors that could contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue

All drivers have a legal obligation to exercise due care in order to avoid causing accidents. Many collisions are caused by drivers that make dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left must first yield the right of way to any vehicle that is close enough so as to pose a hazard. If a driver makes an abrupt left turn in front of another vehicle, this could form the basis of a negligence claim.

Pickup trucks are often used for commercial purposes. If a pickup truck driver was working when they were involved in a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their employment. For example, a pickup truck driver may have been delivering packages when they were involved in a crash. There are a number of steps that should be taken after any car accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Photos of the accident site should be taken.
  • An independent investigation should be conducted.

The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, drivers will often fight extremely hard to deny liability for any collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
