SALINAS, CALIFORNIA (November 7, 2022) – A 20-year-old man identified as Luis Ferro-Sanchez died in a Salinas accidental shooting with an off-duty police officer on Antelope Drive.

Monterey County officials are saying that the incident took place around 5:45 p.m. on Friday. An off-duty Santa Cruz police officer was cleaning his personal gun when he accidentally fired a single round that went through his hand and struck Luis Ferro-Sanchez in the torso.

Paramedics were called to the scene of the shooting in order to help both people. The officer and the victim were both taken to the hospital.

Despite life-saving measures, Luis Ferro-Sanchez died as a result of his injuries. The police officer involved in the shooting has been placed on administrative leave pending an investigation.

Liability For Salinas Accidental Shootings

Accidental shootings are far more common than most people realize. According to the Educational Fund to Stop Gun Violence, around 500 people die from unintentional firearm injuries every year. Unintentional shootings account for around 37% of non-fatal firearm injuries. There are a number of steps that can be taken to prevent accidental shootings.

  • Guns should always be stored in a secure place when not in use.
  • Guns should only be loaded before they are ready to be fired.
  • Guns should be checked and unloaded after any use.
  • Guns should always have the safety on except when they are ready to be used.
  • Gun owners should always treat their gun as if it is loaded.
  • A gun should never be pointed in the direction of another person or animal unless it is about to be used.

Police officers must undergo specialized training and are expected to understand how to handle their firearm safely. They must do everything possible to prevent the unintentional discharge of their firearm. In general,  police departments are not liable for the negligent actions of their off-duty officers. But a police officer could be liable in a personal capacity if they were negligent and injured or killed someone accidentally with their gun. There are a number of steps that should be taken after any accidental shooting.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The conduct of the gun owner should be examined prior to the shooting.
  • A thorough, independent investigation should be conducted.

The family of any person that is killed in an accidental shooting may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. Sadly, though, gun owners will often fight hard to deny liability if they injure someone with their firearm. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
