Lisa Lowe Died In Fairfield Pedestrian Accident Involving Big Rig Truck Along Central Place
FAIRFIELD, CALIFORNIA (November 15, 2022) – A woman identified as Lisa Lowe has tragically died in a Fairfield semi-truck accident on Central Place.
Solano County officials are saying that the accident took place around 5:05 a.m. on Sunday. Lisa Lowe was lying down in the middle of the roadway under unclear conditions.
It is unknown why she was in the roadway or whether she may have been involved in a previous collision. A semi-truck driver was heading down the roadway when they ran over the woman.
Paramedics were called to the scene of the collision in order to help the victim. Sadly, Lisa Lowe was pronounced dead at the scene.
Police interviewed the semi-truck driver who remained at the scene. A full investigation remains ongoing at this time.
Liability For Fairfield Semi-Truck Accidents
Semi-trucks are involved in a disproportionate number of fatal collisions every year. According to the IIHS, “A total of 4,014 people died in large truck crashes in 2020. Fifteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 16 percent were pedestrians, bicyclists or motorcyclists.” There are a number of steps that truck companies should take in order to prevent collisions.
- Truck companies can install collision avoidance systems on their fleet.
- Truck companies should ensure that all of their driver’s are properly licensed and well trained.
- Truck companies should make sure that their vehicles are well maintained.
Truck drivers will typically need to get a commercial license and are held to a high standard in terms of safety. They must use all due care to avoid pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle approaching a pedestrian within a marked or unmarked crosswalk shall reduce their speed and take any other action necessary to safeguard the safety of the pedestrian. If a truck driver failed to reduce their speed and hit a pedestrian, this could form the basis of a negligence claim.
Depending on the facts of any case, the company that a truck driver worked for could face liability for a pedestrian collision. In general, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when they were involved in a crash.
Far too often, people are quick to blame pedestrians hit by vehicles when the victim is in the middle of the road. But the fact of the matter is that drivers must take measures to avoid pedestrians wherever they may be. Moreover, California is a comparative negligence state. Even if the person injured or killed in a collision is partially at fault, this will not prevent them or their family from pursuing a civil claim. There are a number of steps that should be taken after any pedestrian accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- The event data recorder of any truck involved should be examined.
The family of any pedestrian killed in a Fairfield semi-truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that can come with the sudden loss of a loved one. Sadly, though, truck companies will often fight extremely hard to deny liability for any pedestrian collision. This is why it is so important that all evidence is properly preserved after a crash.
