Kandace Florence, Jordan Marshall, Courtez Hall Died In Mexico City Airbnb

MEXICO CITY, MEXICO (November 9, 2022) – Three American tourists identified as Kandace Florence, Jordan Marshall and Courtez Hall died in a Mexico City carbon monoxide poisoning accident at an Airbnb.

Authorities are saying that the three tourists were staying at an Airbnb in Mexico City in order to celebrate Dia de los Muertos. Kandace Florence was talking with her boyfriend in the United States when the call was dropped. She was accompanied by her two friends Jordan Marshall and Courtez Hall.

She reported feeling sick prior to the call being dropped. Her boyfriend tried calling back, but he was not able to reach her again. He then called the Airbnb host to request a welfare check.

Police arrived to the Airbnb and discovered Kandace Florence, Jordan Marshall and Courtez Hall had all died. Authorities believe that the deaths were the result of carbon monoxide poisoning.

A full investigation remains ongoing at this time.

Liability For Airbnb Accidents

Carbon monoxide poisoning accidents are far more common than many people realize. According to the Centers for Disease Control, “Every year, at least 430 people die in the U.S. from accidental CO poisoning. Approximately 50,000 people in the U.S. visit the emergency department each year due to accidental CO poisoning.” There have been several deaths from carbon monoxide poisoning at Airbnbs in recent years. For example, a couple from New Orleans died from carbon monoxide poisoning while staying at an Airbnb rental in Mexico in 2018. There are a number of steps that can be taken to prevent carbon monoxide poisonings.

  • Heaters should be periodically inspected and maintained.
  • Property owners should install carbon monoxide poisoning detectors.
  • Any device that burns fossil fuel should only run in an area that is well ventilated.

Property owners have a legal obligation to maintain their premises in a reasonably safe condition. When a property owner has actual or constructive notice of a dangerous condition with their property, they must take action to remedy the dangerous condition. If a property owner fails to take action to correct a dangerous condition with their property, this could form the basis of a negligence claim. Depending on the facts of any case, Airbnb could potentially be liable for carbon monoxide poisoning.

In 2021, Airbnb was sued in San Francisco County Superior Court for the death of Martin Kraus. The decedent was staying at an Airbnb in El Poblado, Colombia when he died on April 11, 2019. It was determined that he died from carbon monoxide exposure from a tankless water heater. Airbnb is being charged with wrongful death, premises liability, negligence, fraud/deceit/intentional misrepresentations, breach of fiduciary duty, violation of the Consumers Legal Remedies Act. There are a number of steps that should be taken after any incident at an Airbnb.

  •  Any police report of the incident should be reviewed.
  • Photos of the accident site should be taken.
  • Maintenance records should be examined.
  • A thorough, independent investigation should be conducted.

The family of any person that died at an Airbnb property may be able to seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and emotional distress. Sadly, though, Airbnb has consistently demonstrated that it will do everything within its power to deny liability for any injury or death on their properties. This is why it is so important that all evidence is properly preserved after any incident.
