Liability For San Jose Car Accidents

Far too many people are killed or seriously injured every year in pedestrian collisions. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes. One in six people who died in crashes in 2020 were pedestrians.” There are a number of steps that drivers should take in order to avoid collisions.

  • Drivers should slow down during periods of reduced visibility.
  • Drivers should abstain from alcohol and other intoxicating drugs.
  • Drivers should be well rested before heading out on the road.

If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
