Liability For Ceres Pedestrian Accidents
Thousands of people are killed or seriously injured in pedestrian collisions every year. According to the IIHS, “Pedestrian motor vehicle crash deaths have increased 59 percent since reaching their low point in 2009 and account for 17 percent of crash fatalities. The rates of pedestrian deaths in motor vehicle crashes per 100,000 people are highest for people ages 20-69.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should slow down during periods of inclement weather.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should continuously scan the road ahead of them for hazards.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Many pedestrian accidents are due to drivers that are not paying sufficient attention to the road. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall exercise all due care to avoid hitting any pedestrian in the roadway. Drivers shall reduce their speed and take other actions necessary to safeguard the well-being of any pedestrian in the roadway. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a pedestrian accident could extend beyond any driver. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. Pickup trucks are often used for commercial purposes in the fields of construction and landscaping. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of pedestrian accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Sadly, though, drivers will often fight hard to deny liability for any collision. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
