The mirror of the truck apparently struck the pedestrian. Paramedics were called to the scene of the collision in order to help the victim.
An ambulance took the victim to the Highland Hospital with critical injuries. A full investigation into the Berkeley pedestrian accident remains ongoing at this time.
Liability For Berkeley Pedestrian Accidents
The Bay Area has a relatively high rate of pedestrian collisions. According to Berkeley city officials, “Collisions disproportionately impact people riding bicycles and people walking. The numbers are stark – collisions involving someone riding a bicycle or walking make up almost 65% of collisions that result in death or severe injury, despite making up just 40% of trips in Berkeley.” There are many steps that city governments can take to prevent pedestrian collisions.
- City officials should utilize traffic calming measures in areas known for speeding.
- City officials should study which intersections and roads have the most collisions.
- City officials should heavily enforce traffic violations likely to lead to pedestrian collisions.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to California Vehicle Code 21950, the driver of any vehicle approaching a pedestrian in the roadway shall reduce their speed and take any other measure to avoid hitting them. If a truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. A city could also be held at fault for a collision if it was caused by a dangerous condition on public property. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
