Liability For San Jose Hit-And-Run Car Accidents

California has one of the highest instances of hit-and-run collisions in the United States. According to Value Penguin, “California experienced the largest share of fatal hit-and-runs in this period. The number of Golden State crashes accounted for 17% of the U.S. total, with 2,948 crashes causing 3,056 deaths. Texas and Florida also logged more than 1,000 fatal hit-and-runs (1,965 and 1,739, respectively).” The vast majority of hit-and-run accidents are due to driver error. Driver error can come in many forms including:

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall exercise all due care and reduce their speed as necessary to safeguard the safety of any pedestrian. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. Any driver that flees a collision that causes bodily injury could face criminal and civil liability. Victims of car accidents tend to suffer serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. Many accident victims may not realize the full extent of their injuries for several months after an accident. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
