Liability For Fresno County Semi-Truck Accidents
Semi-trucks are especially dangerous for those in passenger vehicles. A fully loaded semi-truck can weigh as much as 80,000 lbs. Even a low impact collision can be catastrophic. According to Trucking Info, “In 2021, fatalities in crashes involving at least one large truck were up 13% compared to 2020, according to the National Highway Traffic Safety Administration’s latest traffic fatalities estimates report.” There are a number of factors that could contribute to a semi-truck accident.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All semi-truck drivers will need to get a commercial driver’s license. This requires them to undergo specialized training and become very familiar with how their rig operates. Many collisions are due to truck drivers that disregard traffic signs in rural areas. Pursuant to California Vehicle Code 22450, the driver of any vehicle approaching a stop sign shall stop at the entrance to the intersecting roadway. If a driver goes past a yield sign without stopping, this may be considered prima facie evidence of their failure to yield.
Depending on the facts of any case, the company that a truck driver worked for could be held at fault for a collision. Companies have a legal obligation to ensure that their drivers are properly licensed and well trained. Still, it is common for many truck drivers who are not properly licensed to continue working. There are a number of steps that should be taken after any semi-truck accident.
- Eye witnesses should be interviewed.
- The truck driver’s logbook should be examined.
- The truck’s event data recorder (EDR) should be examined.
- A thorough, independent investigation should be conducted.
The family of any pedestrian killed in a collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help with many of the expenses that can come with the sudden loss of a loved one. However, it is common for truck companies to fight hard to deny all responsibility for a collision. This is why it is so important that all evidence is properly preserved after any collision.
