Liability For Fremont Semi-Truck Accidents
Far too many people are killed or seriously injured every year in semi-truck accidents. According to the National Safety Council, “In 2020, 4,842 large trucks were involved in a fatal crash, a 4% decrease from 2019 but still a 33% increase since 2011. The involvement rate per 100 million large-truck miles traveled is down 5% from 2019, but up 18% since 2011.” There are a number of steps that truck drivers should take in order to avoid collisions.
- Truck drivers should be well rested before the start of their shift.
- Truck drivers should use commercial GPS systems to help plan their routes.
- Truck drivers should take periodic brakes during their deliveries.
All drivers have a legal obligation to exercise due care in order to avoid collisions. A fully loaded semi-truck can weigh as much as 80,000 lbs and can be very difficult to stop. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle on a highway at a speed greater than is reasonable given the prevailing conditions of the roadway. If a truck driver was working at the time of a collision, their employer could potentially be liable for the crash. However, many truck companies will try to avoid liability for crashes by hiring their drivers as “independent contractors.” There are a number of steps that should be taken after any truck collision.
- The truck driver’s logbook should be examined.
- The employment status of the truck driver should be determined.
- Eye witnesses should be interviewed.
- A full, independent investigation should be conducted.
The family of any person killed in a truck accident may have legal recourse through a wrongful death claim. Potential beneficiaries in a civil claim will typically include a victim’s spouse or children. Unfortunately, truck companies will do everything that they can to deny liability for any collision. This is why it is so important that evidence is properly preserved after any collision.
