Liability In Mountain View Pool Drowning Accidents

Drownings are one of the leading causes of death for small children in the United States. According to the Centers for Disease Control, “More children ages 1–4 die from drowning than any other cause of death except birth defects. For children ages 1–14, drowning is the second leading cause of unintentional injury death after motor vehicle crashes.” There are a number of steps that should be taken to prevent drowning accidents.

  • It is nearly always a good idea for young kids to get swimming lessons early on.
  • Small children should always be supervised in the water.
  • Community pools should typically have fences around them.

Property owners in California have a legal responsibility to maintain their property in a reasonably safe condition, under California Civil Code 1714. When a property owner has actual or constructive notice that their property is in a dangerous condition, they must take action to correct the dangerous condition. There are a number of ways that an apartment pool could potentially be in a dangerous condition.

  • The pool area in an apartment may lack self-latching locks, which are typically required under California law.
  • The locks going into a pool area may be broken or otherwise defective.
  • The enclosure for a pool area may not meet minimum height requirements.

The family of any child that died in an apartment pool drowning may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. If a child survived for some period after any accident, family members may also be able to pursue a survival action claim. Sadly, apartment owners will often fight hard to deny responsibility for any drowning accident. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
