Liability In Napa County Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes. There were also an estimated 104,000 emergency department visits of pedestrians treated for non-fatal crash-related injuries in 2020.” There are hundreds of potential factors that could contribute to a pedestrian collision.

  • Drivers are more likely to hit pedestrians if they are speeding.
  • Drivers are more likely to hit pedestrians if they are distracted.
  • Drivers are more likely to hit pedestrians if they are intoxicated.
  • Drivers are more likely to hit pedestrians when they are fatigued.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right-of-way to any pedestrian crossing the roadway within a lawfully marked crosswalk. If a driver hits a pedestrian crossing the street, they could be held at fault through a civil claim. Depending on the facts of any case, liability for a pedestrian collision could extend beyond any driver.

Many pickup trucks are used for commercial purposes such as landscaping or construction. If a pickup truck driver was working at the time of a collision, their employer could be held at fault. In general, employers are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any pedestrian collision.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any pedestrian that died in a collision may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that evidence is properly collected after any collision. Evidence will be crucial in demonstrating fault for any collision.
