Liability For San Diego Pedestrian Accidents
San Diego County has one of the highest instances of pedestrian accidents in the United States. According to the San Diego city government, “On average, 1,000 pedestrians and bicyclists are hit and seriously injured each year in San Diego. Pedestrian collisions increased 20% in 2012 and fatalities almost doubled – these numbers have not decreased.” There are a number of steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should check their blind spots before making turns.
- Drivers should be well-rested before heading out on the road.
Every driver has a legal obligation to exercise due care in order to avoid pedestrians in the roadway. The vast majority of pedestrian collisions are avoidable and due to some amount of driver error. When a driver fails to slo down and hits a pedestrian, this could form the basis of a negligence claim. If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. Victims of pedestrian collisions tend to suffer very serious and costly injuries including:
- Broken bones
- Lacerations
- Spinal cord injuries
- Head injuries
Pedestrians are protected by a number of laws. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the expenses that come with the sudden loss of a loved one. However, it is common for drivers to deny all responsibility if they hit a pedestrian. This is why it is so important that all evidence is properly preserved after a crash.
