Liability In San Diego Car Accidents
Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the San Diego city government, “On average, 1,000 pedestrians and bicyclists are hit and seriously injured each year in San Diego. • Pedestrian collisions increased 20% in 2012 and fatalities almost doubled – these numbers have not decreased.” City officials have put forward a number of suggestions on how pedestrian accidents can be reduced.
- The ten most dangerous intersections need to be fixed.
- Pedestrian crossing policy should be updated.
- Police and city officials should engage in an education campaign.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. This includes traveling the speed limit. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall yield the right of way to any pedestrian that is close enough to pose a hazard. If a driver goes past a yield sign without stopping, this may be considered prima facie evidence of their failure to yield. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Fractures
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that evidence is properly preserved after any collision. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
