Liability For San Diego County Semi-Truck Accidents
Semi-trucks are essential for the economy and transport the vast majority of goods that are bought and sold every year. However, truck drivers are put under an enormous amount of pressure to complete their routes as quickly as possible. According to the National Transportation Safety Board, “Research has suggested that truck driver fatigue is a contributing factor in 30 to 40 percent of all heavy truck accidents.” There are a number of steps that truck drivers are supposed to take in order to combat fatigue.
- Truck drivers must be well-rested before the start of their shift.
- Truck drivers must not work more than 60 hours in a 7 day period.
- Truck drivers must abstain from medications or substances that could make them drowsy during the day.
- Truck drivers must take periodic breaks during their shifts.
All truck drivers are supposed to exercise due care in order to avoid collisions. This is true even if a vehicle is stalled or stopped in the middle of the road. According to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a truck driver fails to slow down to avoid hitting a stopped vehicle, this could form the basis of a negligence claim. Victims of semi-truck accidents tend to suffer very serious and costly injuries including.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The FMCSA requires commercial trucks to carry between $750,000 to $5,000,000 worth of liability coverage. Any person that is injured due to the negligent actions of a truck driver may be able to seek some measure of justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
