SAN DIEGO, CALIFORNIA (February 28, 2023) – A woman was seriously injured in a Pacific Beach hit-and-run car accident on the 2900 block of Garnet Avenue by Mission Bay Drive.

San Diego County officials are saying that the collision took place around 1:24 a.m. on Monday. A vehicle hit a female pedestrian under unclear circumstances and then fled the scene.

Paramedics were called to the scene of the collision in order to help the woman. She was taken to Scripps La Jolla Hospital.

Liability For San Diego County Pedestrian Accidents

San Diego County has an unfortunately high number of pedestrian accidents every year. According to San Diego County officials, “On average, 1,000 pedestrians and bicyclists are hit and seriously injured each year in San Diego. Pedestrian collisions increased 20% in 2012 and fatalities almost doubled – these numbers have not decreased.” There are a number of steps that cities can take in order to prevent pedestrian collisions.

  • Cities can install traffic calming measures in areas with a history of speeding.
  • Cities can make more areas pedestrian only zones.
  • Cities can heavily enforce traffic violations likely to lead to pedestrian accidents.

All drivers have a legal responsibility to take measures to avoid pedestrians in the roadway. According to California Vehicle Code 21950, the driver of a vehicle must reduce their speed and take any other action necessary to avoid colliding with a pedestrian. If a driver fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. There are many steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A personal injury attorney should be consulted.

It is common for accident victims to not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
