Liability In Escondido Motorcycle Accidents
Motorcyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are much more likely to be overlooked. According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles. Operating a motorcycle requires a different combination of physical and mental skills than those used in driving four-wheel vehicles.” There are a number of factors that could contribute to a motorcycle accident.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to vehicles that break traffic regulations. Pursuant to California Civil Code 21804, the driver of a vehicle about to enter or cross a road from a public or private driveway must first yield the right-of-way to any vehicle that is close enough so as to constitute an immediate hazard. They must continue yielding until they are able to proceed with reasonable safety.
Many cargo vans are used for commercial purposes. If the driver of a cargo van was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any car accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
The family of any person that is killed in a car accident is protected by a number of laws. They have the ability to seek some measure of justice through a civil claim. Damage in a civil claim can help cover some of the expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
