Despite the best efforts of first responders, the Harley Davidson motorcyclist died as a result of their injuries. The driver of the pickup truck fled the scene but was later captured by police.
They have since been charged with felony DUI and felony hit-and-run. A full investigation remains ongoing at this time.
Liability For Fallbrook Motorcycle Accidents
Driver intoxication remains one of the leading causes of fatal car accidents in the United States. According to the NHTSA, “Despite the fact that it’s illegal to drive drunk, one person was killed every 45 minutes in a drunk driving crash on our nation’s roads in 2020. That’s a total of 11,654 people who died in alcohol-impaired driving crashes in one year.” What many drivers do not realize is that there are a number of substances that could potentially intoxicate them besides alcohol.
- Methamphetamines
- Benzodiazepines
- Marijuana
- Prescriptions
- Over-the-counter medications
All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to drivers that make dangerous left turns. Pursuant to California Vehicle Code 21801, the driver of any vehicle intending to turn left or complete a U-turn must first yield the right-of-way to all drivers approaching from the opposite direction that are close enough so as to pose a hazard. If a driver makes an abrupt left turn in front of a motorcyclist, this could form the basis of a negligence claim. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
When a driver causes a fatal collision, they can be held accountable through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Potential beneficiaries will typically include a victim’s next of kin such as their spouse or children. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
