Liability In San Diego Motorcycle Accidents

Far too many motorcyclists are killed or seriously injured in collisions every year. According to the NHTSA, “Motorcycle riders continue to be overrepresented in fatal traffic crashes. […] Per vehicle miles traveled in 2019, motorcyclists were about 29 times more likely than passenger vehicle occupants to die in a motor vehicle crash and were 4 times more likely to be injured.” There are dozens of potential factors that could contribute to a motorcycle collision including:

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue
  • Driver intoxication

Many motorcycle collisions are due to drivers that make dangerous left turns in the roadway. According to California Vehicle Code 21801, any driver intending to turn left in the roadway shall yield the right of way to all vehicles traveling from the opposite direction that are close enough so as to pose a hazard. Any driver that makes an abrupt left in front of a motorcyclist will typically be held at fault in the event of a collision. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Any person that is injured due to the negligent actions of another driver may have recourse through a civil claim. Damages can help cover lost wages, medical bills and pain and suffering. It is important that victims seek legal advice early on. A motorcycle accident attorney can examine all of the facts of your case and let you know what your legal options are.
