Liability In San Diego Car Accidents
Car accidents remain one of the leading causes of serious injury and death in the United States. According to the IIHS, over 33,000 people were killed in motor vehicle accidents in the United States in 2019. Tens of thousands more were left with serious injuries. Nearly one third of all fatal crashes involved an intoxicated driver. There are many other factors that could potentially contribute to a collision.
- Drivers are more likely to crash when they are speeding.
- Drivers are more likely to crash if they are intoxicated.
- Drivers are more likely to crash if they are inexperienced.
All drivers have a legal obligation to exercise due care in order to avoid causing accidents. This includes maintaining a safe speed. Pursuant to California Vehicle Code 22450, no driver shall operate a motor vehicle at a speed greater than what would be safe or reasonable given the prevailing conditions of the roadway. They must also maintain their vehicle within one lane of traffic unless they are able to change lanes safely. If a driver hits a median before going back into traffic, they can be held at fault through a civil claim.
Many pickup trucks are used for commercial purposes. If the driver of a pickup truck was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a driver may have been delivering packages at the time of a collision.
A city could also potentially be liable for an accident if it was caused by a dangerous condition with a roadway. According to California Vehicle Code 835.2, a public entity can be liable for a dangerous condition on their property provided that they had actual or constructive notice of the dangerous condition. There are a number of ways that a roadway could be in a dangerous condition. For example, a roadway may lack appropriate traffic control devices or signs. There are many steps that should be taken after any car accident.
- Surveillance footage should be sought.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- The purpose of the errant driver’s trip should be determined.
The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. A civil claim can help cover many of the expenses that can come with the sudden and tragic loss of a loved one. Potential beneficiaries in a civil claim will typically include a victim’s spouse, parents or children. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
