Liability In Victorville Pedestrian Accidents

California has one of the highest rates of pedestrian accidents in the entire country. According to Patch, “Pedestrian deaths in California increased by nearly 2 percent from June 2020 to 2021, according to a new report. In 2021, California had 470 reported pedestrian fatalities, compared to 463 pedestrian fatalities in 2020 and 460 in 2019.” There are a number of steps that drivers should take in order to avoid pedestrian accidents.

  • Drivers should be well rested before they get into a car.
  • Drivers should abstain from alcohol and other intoxicating substances.
  • Drivers should always scan the road ahead of them for potential hazards.

Every driver has a legal obligation to exercise due care to avoid hitting pedestrians. They must also operate their vehicle at a safe speed. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than would be reasonable given the prevailing conditions of the roadway. If a driver fails to reduce their speed to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are several  elements that must be demonstrated in any negligence claim.

  • The defendant owed the plaintiff a duty of care.
  • The defendant breached that duty of care.
  • The breach was the proximate cause of the plaintiffs injuries.
  • The plaintiff sustained injuries.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine the unique facts of your case and let you know what your legal options are.
