Liability In Victorville Semi-Truck Accidents

Car accidents remain one of the leading causes of serious injury and death in the United States. Semi-trucks in particular are involved in approximately 4,000 fatal collisions annually. According to the FMCSA, there are a number of factors that could potentially contribute to a truck accident including vehicle design and manufacture, highway conditions, weather conditions and traffic signaling. There are many reasons that semi-trucks can be particularly dangerous to smaller vehicles.

  • Semi-trucks have a high ground clearance thereby making underride collisions more likely.
  • Semi-trucks have a wide turning radius.
  • Semi-trucks have large blind spots that can obscure the presence of smaller vehicles.

Semi-truck drivers need to get a commercial license and go through extensive training. However, they are also put under a lot of pressure to complete their routes as quickly as possible. Nearly 1 in 10 truck drivers involved in a fatal crash report being under pressure from work as a contributing factor in the crash. This often leads to truck drivers making dangerous turns within intersections. If, for example, the driver of a semi-truck makes a left turn in front of another vehicle, they could be held liable in the event of a collision. There are a number of steps that should be taken after any truck accident.

  • The truck’s event data recorder (EDR) should be examined.
  • Surveillance footage of the accident site should be sought.
  • The truck driver logbook should be reviewed.
  • Photos of the accident site should be taken.

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Trucks that carry hazardous materials will typically need higher insurance rates. Any person that is injured due to the negligence of a truck driver may have recourse through a bodily injury claim. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
