Liability In Caleveras County Jet Ski Accidents

Thousands of people are seriously injured in jet ski accidents every year. According to Jet Drift, there are around 12 million registered recreational vehicles in the United States. Around 1.5 million of those vehicles are jet skis. Even though jet skis make up only a small percentage of registered aquatic vehicles, they are involved in a around 20% of all reported aquatic accidents. There are many factors that could potentially contribute to a jet ski accident.

  • Distracted driving
  • Inclement weather
  • Driver intoxication
  • Driver fatigue
  • Driver inexperience

Driving a jet ski is no easy task. It takes a good amount of time for a person to become familiar with how a jet ski controls. It takes much longer for a person to learn how to operate a jet ski safely. A large number of jet ski collisions are due to operator inexperience. The operator of a jet ski may forget how to decelerate.

There are rules for operating boats or jet skis in much the same way that there are rules with respect to driving a car. California law requires jet ski operators to reduce their speed when they are near any person in the water. If the driver of a jet ski fails to reduce their speed and hits someone in the water, this could form the basis of a negligence claim.

The company that rented a jet ski could also potentially be liable for a jet ski accident. Any company that rents a boat or jet ski must ensure that the person they are renting to is otherwise qualified to operate it. If a jet ski rental company lends their jet ski to someone who is not qualified to operate it, this could form the basis of a negligent entrustment claim. There are numerous elements that must be demonstrated for a negligent entrustment claim involving a rented jet ski.

  • The operator of the jet ski was unfit to drive it safely when they were given permission to drive it.
  • The owner of the jet ski knew (or should have known) that the operator of the jet ski was unfit to drive it safely.
  • The owner of the jet ski entrusted it to the person unfit to drive it safely.
  • The incompetence of the jet ski driver is what caused the plaintiff to suffer injuries.

Any person that is injured in a jet ski accident may be able to seek damages through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, jet ski operators and jet ski rental companies will often fight extremely hard to deny liability for an accident. A jet ski accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
