Liability In Jamestown Pedestrian Accidents
Car accidents remain one of the major sources of serious injury and death in the United States. According to the Centers for Disease Control, more than 7,000 pedestrians were killed in motor vehicle accidents in 2020. More than 1/3 of fatal pedestrian collisions involve an intoxicated driver. Generally speaking, small children and older adults tend to be at the greatest risk of being involved in a pedestrian collision. There are a number of factors that could influence the likelihood of pedestrian collisions including:
- Driver fatigue
- Inclement weather
- Distracted driving
- Drug use
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall yield the right-of-way to any pedestrian crossing the roadway within any marked crosswalk. When a driver fails to exercise due care and strikes a pedestrian, they could be held at fault through a civil claim. Victims of pedestrian accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Many accident victims may not realize the full extent of their injuries for several weeks or months after a collision. Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
