Liability For Granite Bay Walmart Accidents
Accidents involving vehicles that go into storefronts are much more common than many people realize. According to the Storefront Safety Council, there are around 100 incidents every day where vehicles go into strorefronts. These accidents result in over 16,000 injuries annually. Around 24% of the collisions take place in front of retail stores. There are a number of factors that could contribute to a storefront collision.
- Many storefront collisions are due to drivers that experience “pedal confusion.” This occurs when a driver mistakes the gas for the brakes. Elderly drivers are much more likely to experience pedal confusion than any other age group.
- A large number of storefront collisions are due to drivers that are intoxicated. There are many substances besides alcohol that could potentially intoxicate a driver.
- Driver distraction is another major cause of storefront collisions. Drivers may be distracted by their phones or conversations with other people.
It is illegal for any driver to operate a motor vehicle under the influence of alcohol or drugs. Pursuant to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” If a driver was intoxicated when they hit a group of pedestrians, they could face liability for the collision through the doctrine of negligence per se.
Depending on the facts of any case, a property owner could face liability for a storefront collision on their property. Pursuant to California Civil Code 1714, a property owner can be liable for an injury or death on their property provided that it was caused by a dangerous condition on the property. A dangerous condition could exist if a property owner fails to install bollard posts on their property. Bollard posts are solid concrete or metal structures that can prevent vehicles from entering storefronts. There are a number of steps that should be taken after any storefront collision.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- The number of storefront collisions at the property or sister properties should be understood.
- A thorough investigation should be conducted.
