Liability In Fresno Car Accidents

Accidents involving vehicles that drive into storefronts may seem like freak occurrences, but they are actually quite common. According to security consultant Rob Reiter, at least 100 American drivers hit buildings each day. That translates to around 36,500 such accidents every year. These accidents result in around 16,000 injuries and more than 2,500 deaths. Most of these accidents are due to “pedal confusion” – i.e., a situation where the driver mistakes the gas for the brakes. There are many factors that could potentially contribute to pedal confusion.

  • Driver intoxication
  • Prescription drugs
  • Driver distraction
  • Driver fatigue

Elderly drivers are more likely to experience pedal confusion. All drivers have a legal obligation to exercise due care in order to avoid collisions. If a driver suddenly accelerates into a building and hits someone, this could form the basis of a negligence claim. Depending on the facts of any case, liability for such an accident could extend beyond any negligent driver.

All property owners in California have a legal obligation to maintain their premises in a reasonably safe condition, according to California Civil Code 1714. There are steps that can be taken in order to protect guests against vehicles that go into buildings. For example, property owners can install steel or concrete bollard posts that block vehicles. In some circumstances, failure to protect guests from errant vehicles could be negligent. There are many steps that should be taken after any accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A personal injury attorney should be consulted.

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often do everything in their power to avoid helping accident victims. A personal injury attorney can examine the unique facts of your case and let you know if you have a valid claim that can be pursued.
