Liability For Fresno School Bus Accidents
Buses tend to be very safe for their passengers. But they can be particularly dangerous for those in smaller vehicles. According to The Journalist’s Resource, “about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” Bus drivers should take a number of steps to avoid collisions.
- Bus drivers should continuously scan the road ahead of them.
- Bus drivers should check their blind spots before changing lanes.
- Bus drivers should slow down during periods of inclement weather.
Bus drivers must exercise due care to avoid collisions. Pursuant to California Vehicle Code 21703, the driver of a motor vehicle shall not follow another vehicle more closely than would be reasonable or prudent given the prevailing conditions of the roadway. If a bus driver fails to slow down to avoid causing an accident, this could form the basis of a negligence claim. Victims of bus accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The FMCSA requires commercial buses that can carry 16 or more people to have at least $5,000,000 worth of liability coverage. Any person that is injured in a school bus accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
