Liability In Lincoln Hills Pedestrian Accidents
Thousands of people are killed or seriously injured every year in pedestrian collisions. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” The vast majority of pedestrian collisions are totally preventable. There are many factors that could contribute to pedestrian accidents.
- Distracted driving
- Inclement weather
- Driver fatigue
- Poor road conditions
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of any vehicle shall yield the right of way to any pedestrian that is crossing the road in any marked or unmarked crosswalks. If a driver fails to reduce their speed to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:
- Broken bones
- Lacerations
- Spinal cord injuries
- PTSD
The family of any person that is killed in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It is important that all evidence is properly preserved after a car accident. Evidence is what will ultimately be used to determine liability.
