Liability In Sacramento Inmate Deaths
Far too many inmates die in custody every year. According to the Prison Policy Initiative, “Nationwide, there were 1,120 deaths reported, or a rate of 154 deaths per 100,000 people in jail, the highest levels since BJS’ first report on this topic in 2000.” There are a number of steps that jails can take in order to help keep inmates safe during their stay.
- Correctional officers should be properly trained.
- Correctional officers should be able to identify when an inmate is in distress.
- Jails should be properly staffed.
All inmates have a constitutional right to receive reasonably adequate healthcare. When a jail is deliberately indifferent to the serious medical needs of an inmate this could form the basis of a negligence claim. For example, a jail may have waited too long to help an inmate in medical distress. The family of any inmate that died may have legal recourse through a wrongful death claim.
