Liability For Clovis Pedestrian Accidents
Fresno County has become increasingly dangerous for pedestrians. According to Your Central Valley, “So far [in 2018], there have been 21 pedestrian deaths, according to police numbers [in Fresno County]. It accounts for 64 percent of the city’s total deadly collisions.” Pedestrians are uniquely vulnerable in collisions. They lack the protection of enclosed vehicles and are more likely to be overlooked. There are a number of steps that drivers should take to avoid colliding with pedestrians.
- Drivers should slow down at night and during periods of inclement weather.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should check their blind spots before making turns.
All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. Pursuant to California Vehicle Code 21950, the driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.
Utility vans are often used for commercial purposes. If the driver of a van was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any pedestrian accident.
- The employment status of any van driver should be determined.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
Victims of car accidents are protected by a number of laws. The family of any person that is killed due to the negligent actions of a driver may have legal recourse through a wrongful death claim. Unfortunately, it is very common for drivers to fight hard to deny liability for any collision. This is why it is so important that evidence is properly preserved after any collision. Evidence is ultimately what will be used to establish liability for an accident.
