Liability For Turlock Semi-Truck Accidents
Driving a commercial truck can be especially dangerous. According to the Bureau of Labor Statistics, “During 2012, 756 truck drivers lost their lives in work related incidents, while over 65,000 private sector truck drivers suffered injuries and illnesses that resulted in time away from work.” Many car accidents are totally preventable and due to one of the following errors.
- Drivers may fail to check their blind spots before turns.
- Drivers may follow the lead vehicle too closely.
- Drivers may get distracted by their cell phones.
All drivers have a legal obligation to exercise due care in order to avoid collisions. Pursuant to California Vehicle Code 21801, any driver intending to turn left or make a U-turn in the roadway must first yield the righ-of-way to vehicles that are traveling from the opposite direction that are close enough so as to pose a hazard. If a driver fails to yield to oncoming vehicles before making a U-turn, this could form the basis of a negligence claim. Victims of truck accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
If a mail truck driver was working at the time of a collision, their employer could be held at fault. In general, employers are liable for the wrongful acts of their employees – insofar as those employees were working within the course and scope of their job duties. Any person that is injured in a collision with a mail truck may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
