Liability In Fresno County Car Accidents

Thousands of people are seriously injured or killed along California’s Roads every year. According to the California Office of Traffic Safety, “In 2019, 50% of all drivers killed in motor vehicle crashes, who were tested, tested positive for legal and/ or illegal drugs, an increase of 8% from 2018.” There are many other factors that could potentially contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver fatigue
  • Driver distraction

If a person is injured at work, they or their family may be entitled to benefits through the worker’s compensation system. Worker’s compensation in California operates through a no-fault system. There is no need to demonstrate that a driver or anyone else acted negligently. Damages through the worker’s compensation system can help cover lost wages, disability benefits and funeral expenses. An injured worker may also be able to pursue damages through a negligence claim.

All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to drivers that fail to follow traffic regulations. According to California Vehicle Code 22450, the driver of any vehicle approaching a stop sign shall stop at the limit line before entering the crosswalk near the intersection. If a driver goes through a stop sign and causes an accident, they could be considered negligent per se.

If the driver of any transport van worked for a different company than the worker who was injured, their employer could also be held at fault. Employee’s can’t bring negligence claims against their employers. But they can pursue a claim against a company separate from their employer. This could include a company responsible for transporting farmworkers to their jobs. There are a number of steps that should be taken after any collision.

  • Surveillance footage should be sought.
  • A driver that went through a stop sign may need to be evaluated for drugs or illegal substances.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and pain and suffering. Sadly, though, it’s common for companies to deny responsibility for any collision involving their drivers. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
