Janet Capes Injured In Hayfork Car Accident on Highway 3 By Brady Road

HAYFORK, CALIFORNIA (January 9, 2022) – A woman identified as Janet Capes was seriously injured in a Hayfork pedestrian accident on Highway 3 not far from Brady Road.

Trinity County officials are saying that the accident took place around 6:45 p.m. on Tuesday. Janet Capes was walking along Highway 3 when she was hit by a vehicle.

That driver remained at the scene and called 911. Paramedics arrived at the scene and took Janet Capes to the hospital with serious injuries.

CHP officials said that it was raining and foggy when the collision took place.

Liability For Hayfork Pedestrian Accidents

Inclement weather is a major contributing factor in many car accidents every year. According to the FHWA, “Low visibility conditions cause increased speed variance, which increases crash risk. Each year, over 38,700 vehicle crashes occur in fog. Over 600 people are killed and more than 16,300 people are injured in these crashes annually.” There are many steps that drivers should take during periods of inclement weather.

  • It may be wise for drivers to pull over or avoid driving all together during periods of heavy fog or rain.
  • Drivers should slow down to below the speed limit during inclement weather.
  • Drivers may need to turn on their high beams during heavy fog.

All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. Pursuant to California Vehicle Code 22350, no person shall drive a motor vehicle at a speed greater than what would be safe or reasonable given the prevailing conditions of the road. If a driver fails to slow down during periods of heavy fog and hits a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Many victims of pedestrian accidents may not realize the full extent of their injuries for several weeks or months. Even after a person’s physical injuries have healed, it is common for accident survivors to suffer long-term PTSD. Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
