Liability In Fresno Bicycle Accidents
Bicyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. The vast majority of bicycle accidents involve some amount of human error. Drivers may be intoxicated or they may fail to properly scan the road ahead of them. There are a number of steps that drivers should take in order to avoid bicyclists.
- Drivers must maintain three feet of separation from bicyclists at all times.
- Drivers must check their blind spots before making turns.
- Drivers must scan the road ahead of them for potential hazards.
All drivers have a legal obligation to exercise due care in order to avoid causing accidents. According to California Vehicle Code 21200, “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs, and by Division 10.” If a driver strikes a bicyclist they could be held at fault through a civil claim. There are many steps that should be taken after any bicycle accident.
- Surveillance footage of the accident should be sought.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- A thorough, independent investigation should be conducted.
The family of any victim that died in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, insurance companies will often fight hard to deny liability for a crash. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are.
