Liability In Riverside County Truck Accidents
There are tens of thousands of truck accidents that take place every year. According to the FMCSA, “There were 13.65 fatal large truck crashes per million people in the United States in 2019, a 29-percent increase from 10.6 in 2010. In 2019, on average, there were 1.12 fatalities in fatal crashes involving large trucks. In 91 percent of those crashes, there was only one fatality.” There are many factors that could potentially contribute to a truck accident.
- Trucks take much longer to stop than passenger vehicles.
- Truck drivers are often asked to work at odd hours and may become dangerously fatigued.
- Trucks have large blind spots that can obscure the presence of smaller vehicles.
Truck drivers must get a commercial driver’s license and are held to a high standard in terms of safety. According to California Vehicle Code 21703, the driver of a motor vehicle shall not follow another vehicle more closely than what would be reasonable and prudent given the speed of their vehicle and the conditions of the roadway. Even if a car is stopped in the middle of the road, drivers must maintain a sufficient distance in order to be able to stop in time.
Truck accidents are nearly always preventable and typically involve some amount of human error. Truck drivers can work for 60 hours per week and typically drive more than 107,000 miles per year. This puts them at a greater risk of distracted and drowsy driving. The Centers for Disease Control estimates that staying awake for only 18 hours reduces a person’s driving capacity equivalent to driving with a BAC of 0.05%. There are many steps that truck drivers and truck companies can take in order to prevent accidents.
- Truck drivers should make sure that they are adequately rested.
- Truck drivers should abstain from alcohol or medications that could potentially impair them.
- Truck companies should make sure that their fleets are well-maintained.
- Truck companies should use technology such as forward collision avoidance systems.
When a truck driver is negligent and kills another driver they can be held accountable through a civil claim. The family members of any victim may be able to seek some measure of justice through California Code of Civil Procedure 377.60. Damages can help cover lost wages, medical bills and funeral expenses. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
