Liability In Riverside Car Accidents

Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the Centers for Disease Control, nearly 6,000 people were killed in car crashes in 2017. Another 137,000 pedestrians were seriously injured. Elderly pedestrians and young children were at the greatest risk of being involved in collisions. There are a number of steps that drivers and pedestrians can take in order to reduce collisions.

  • Pedestrians can wear reflective clothing to increase their visibility.
  • Pedestrian should avoid using electronic devices when crossing the road.
  • Drivers should slow down when near pedestrians.
  • Drivers should check their blind spots before making turns.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” If a driver hits a pedestrian, they could be held at fault through a civil claim.

Liability could extend beyond any driver at fault for a collision. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. This will typically be the case if the employee was working within the course and scope of their job duties. An action will typically be within the scope of a worker’s duties if it is substantially related to what they were hired for. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that evidence is preserved after an accident. Evidence is what will ultimately be used to determine liability. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
