Liability In Temescal Valley Semi-Truck Accidents
Thousands of people are killed or seriously injured every year in semi-truck accidents. There are a number of factors that could potentially contribute to a semi-truck accident. According to the FMCSA, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” Truck drivers should take a number of precautions in order to avoid collisions.
- Truck drivers should be well-rested before the start of their shift.
- Truck drivers should have their vehicles regularly inspected and properly maintained.
- Truck drivers should take periodic brakes during their shift.
Truck drivers must go through extensive training and acquire a commercial license. Many collisions are due to truck drivers that make unsafe lane changes. According to California Vehicle Code 22107, no person shall move their vehicle left or right upon a roadway unless such a movement can be made with reasonable safety. One of the major safety concerns with semi-trucks is that they have large blind spots that can obscure the presence of smaller vehicles. If a truck driver is negligent and hits a sedan, the company that they were working for may bear some responsibility for the crash.
As a general rule, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, many truck companies will try to evade liability for crashes by hiring truck drivers as “independent contractors.” Companies typically will not be liable for the negligent actions of their independent contractors – unless those workers were performing some type of non-delegable duty. Victims of semi-truck accidents tend to suffer very serious injuries including.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Death
The FMCSA requires most commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured in a semi-truck accident may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
