Liability For Oasis Semi-Truck Accidents
Far too many motorcyclists are seriously injured or killed every year in car accidents. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 18% of all occupant fatalities, and 4% of all occupant injuries in 2020.” There are a number of factors that could contribute to a motorcycle collision.
- Speeding
- Distracted driving
- Inclement weather
- Driver fatigue
- Poor road conditions
Semi-truck drivers will typically need to get a commercial license and are held to a high standard in terms of safety. Many collisions are due to truck drivers that make unsafe lane changes. Pursuant to California Vehicle Code 22107, no person shall turn a vehicle from a direct course or move right or left upon a roadway unless such a movement can be made with reasonable safety. There are a number of steps that should be taken after any motorcycle accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough, independent investigation should be conducted.
The FMCSA requires trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured due to the negligence of a truck driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, truck drivers will often fight hard to deny liability for any collision. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
