Liability In Riverside In Custody Deaths

California has one of the highest instances of in custody deaths in the United States. According to Open Justice, “The majority of deaths in custody from 2011 to 2020 resulted from natural causes (53.7%), such as illnesses among jail and prison inmates serving their sentences after a conviction. This was followed by Justifiable Homicide by law enforcement officers or staff (14.5%) as the second leading cause of death.” There are a number of steps that jails should take in order to protect the health and safety of inmates.

  • Inmates should receive adequate healthcare.
  • Inmates should be properly monitored.
  • Correctional officers should be properly trained.

All inmates have a constitutional right to receive reasonably adequate healthcare. When a jail is deliberately indifferent to the serious medical needs of an inmate who dies, this could form the basis of a legal claim. For example, correctional officers may know (or should have known) that an inmate was experiencing a health crisis and failed to act. There are a number of steps that should be taken after any inmate death.

  • Medical records should be preserved.
  • An independent autopsy should be performed.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

A large number of in custody deaths are totally preventable. The family of any inmate that died in custody may have legal recourse through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that evidence is preserved after any in custody death. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
