RIVERSIDE COUNTY, CALIFORNIA (January 8, 2022) – A 32-year-old man identified as Everardo Calvillo Jr died in a Riverside County semi-truck accident on Interstate 10.

California Highway Patrol are saying that the collision took place on Christmas night. The driver of a semi-truck made an unsafe lane change directly into the path of a Toyota Camry.

The two vehicles did not collide. However, the Camry driven by Everardo Calvillo Jr rolled several times as the driver attempted to take evasive action.

Police said that the semi-truck driver left the scene and is currently being sought. Firefighters and paramedics were called to the scene of the collision in order to help all of the victims.

Everardo Calvillo Jr was ejected from the Toyota Camry and died due to the severity of his injuries. Three other people including a 1-year-old, 14-year-old and 15-year-old were injured and taken to the hospital.

Liability For Riverside County Semi-Truck Accidents

Semi-trucks make a up a relatively small number of the total vehicles on the roadway. But they are disproportionately involved in fatal collisions. According to the IIHS, “A total of 4,014 people died in large truck crashes in 2020. Fifteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 16 percent were pedestrians, bicyclists or motorcyclists.” There are a number of steps that truck drivers should take in order to prevent semi-truck accidents.

  • Truck drivers should check their blind spots before making turns.
  • Truck drivers should be well-rested before heading out on the road.
  • Truck drivers should abstain from alcohol and other intoxicating substances.

Semi-truck drivers will typically need to get a commercial driver’s license. They must undergo specialized training and are held to a high standard in terms of safety. Pursuant to California Vehicle Code 22107, no person shall turn a vehicle from a direct course upon a roadway unless such a movement can be made with reasonable safety. If a truck driver makes an unsafe lane change, this could form the basis of a negligence claim.

It is illegal to flee the scene of a collision that results in bodily injury or death. It doesn’t matter whether the driver that fled made contact with another vehicle. What matters is whether the actions of the driver that left the scene were the proximate cause of the collision. Moreover, the company that a truck driver worked for could also be held liable for a collision. Generally speaking, companies are vicariously liable for the wrongful actions of their employees – insofar as those drivers were working within the course and scope of their job duties. There are a number of steps that should be taken after any car accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Truck maintenance records should be examined.

It can be difficult to know where to begin after any semi-truck accident. But it is important that accident victims know that they do have rights. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. A civil claim can help cover many of the expenses that come with the sudden loss of a loved one. Sadly, though, truck companies will often do everything in their power to deny liability for a collision.
