Liability For Palm Springs Motorcycle Accidents
Car accidents remain one of the leading causes of serious injury and death in the United States. Motorcyclists are particularly at risk. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 14% of all traffic fatalities, 18% of all occupant fatalities, and 4% of all occupant injuries in 2020.” There are a number of steps that drivers should take to avoid hitting motorcyclists.
- Drivers should check their blind spots before turning.
- Drivers should slow down during periods of inclement weather.
- Drivers should abstain from alcohol and other intoxicating substances.
Passenger vans that are used to transport customers are typically considered common carriers. They are therefore held to a high standard in terms of safety. According to Acosta v. Southern California Rapid Transit Dist, common carriers must use the utmost care and the vigilance of a very cautious person. A common carrier is responsible for even the slightest negligence and must do all that human care and foresight reasonably can do to prevent collisions.
Many motorcycle accidents are due to drivers that make dangerous turns and fail to see motorcyclists. According to California Vehicle Code 21801, the driver of any vehicle intending to turn left must first yield the right of way to any driver that is close enough so as to pose a hazard. If a driver turns into the path of another vehicle and they collide, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a car accident could extend beyond any driver. Generally speaking, companies are vicariously liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a van may have been transporting passengers when they crashed. There are many steps that should be taken after any car accident.
- The employment status of any van driver should be determined.
- Surveillance footage should be sought.
- Eye witnesses should be interviewed.
- A thorough investigation should be conducted.
When a driver is negligent and causes a fatal collision, they can be held to account through a civil claim. The family of the person that died can seek some measure of justice through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that all evidence is properly preserved after any collision.
