Liability For Santa Ana Inmate Deaths

In custody deaths are far more common than many people may realize. According to Prison Legal News, “A total of 301 federal prisoners died in 2001. In 2015, the deaths hit a maximum of 455. They declined to 378 by 2018. 2,869 state prisoners died in 2001. The number of state prisoner deaths stayed between 3,300 and 3,500 per year between 2008 and 2014, then steadily rose to 4,135, its highest level, in 2018.” There are a number of steps that jails should take in order to prevent inmate deaths.

  • Inmates should get a health screening before being admitted.
  • Inmates should be properly monitored during their stay.
  • Correctional officers should be well trained.

All inmates have a constitutional right to receive reasonably adequate healthcare. When a jail is deliberately indifferent to the serious medical needs of an inmate, this could form the basis of a negligence claim. For example, a jail may not have given an inmate proper medical care for a known condition that they had. A large number of inmate deaths are totally preventable. There are many steps that should be taken after any in custody death.

  • Body camera footage from all officers involved should be reviewed.
  • A thorough investigation should be conducted.
  • Eye witnesses should be interviewed.
  • An autopsy may need to be performed.

The family of any person that died in custody may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, jails will often fight hard to deny all liability for any in custody death. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
